Trade Terms & Conditions

Trade Accounts are available to approved professional businesses only.
By applying for or using a Trade Account, you agree to the following terms.


1. Eligibility

Trade Accounts are offered to interior designers, stylists, home staging companies commercial, hotel and hospitality procurement, and selected retail partners and other approved professional businesses.

Approval is at the discretion of Kirsten Clark Art.
We reserve the right to decline or withdraw trade access at any time.


2. Trade Pricing

Trade pricing is provided to approved partners on selected products only.

  • Discounts are applied to the Recommended Retail Price (RRP)

  • Pricing is confidential and must not be shared publicly

  • Trade pricing may change without notice 


3. Ordering & Payment

  • All products are made to order.
  • Payment is required at the time of ordering
  • Orders cannot be cancelled as they are made to order and processing begins immediately.


4. Shipping & Delivery

Orders are shipped directly to the delivery address provided at checkout.

Orders are processed Monday-Friday (excluding holidays).

Production and delivery timeframes are estimates. While we work to meet these timeframes, delays may occasionally occur due to factors outside our control (e.g. high production demand, weather, courier issues, or holiday periods). We will advise of any known delays and provide tracking details once orders are dispatched. 

Shipping costs are calculated at checkout where applicable.

Orders may be shipped directly to the Trade Partner, project location, or end customer on behalf of the Trade Partner.

The Trade Partner remains the retailer of record and is responsible for all customer communication, product information, and after-sales support.


5. Returns & Faulty Items

Unsold items are not returnable, as all products are made to order.

Fine Art Open Edition Prints & Canvas

All artwork is made to order and carefully inspected prior to dispatch. Returns are not accepted for change of mind.

If an item arrives faulty or damaged in transit, please notify us within 5 working days of delivery with photographs so we can assess the issue. Where a fault is confirmed, the item will be replaced in accordance with consumer law.

Damage occurring after delivery, including improper handling, is not covered.

Art-Led Clothing

STOCKLIST TRADE PARTNER (Holds Inventory)

Clothing is made to order and supplied to the Stockist Trade Partner for resale inventory. Returns are not accepted for change of mind or incorrect size selection.

Any approved return must be in brand-new condition, unworn, with tags attached and free from perfume, deodorant, makeup, washing powder, or other marks.

The Stockist Trade Partner is responsible for return shipping costs unless the item is confirmed faulty.

If an item arrives faulty or damaged, please notify us within 5 working days of delivery with photographs so we can assess the issue.

Where a fault is confirmed, the item will be replaced in accordance with consumer law. If a replacement is not possible, a credit may be issued at our discretion.

DIRECT FULFILLMENT PARTNER

Clothing is made to order and shipped directly to the delivery address provided by the Direct Fulfillment Trade Partner. 

Returns are not accepted for change of mind or incorrect size selection.

The Direct Fulfilment Trade Partner is responsible for all customer communication and for ensuring product information and sizing guidance are accurately provided.

Kirsten Clark Art supplies products to the Direct Fulfilment Trade Partner only and does not provide direct support to end customers.

Returns will only be accepted from the Direct Fulfilment Trade Partner where a product is confirmed faulty. Fault claims must be reported within 5 working days of delivery with supporting photographs.

If a fault is confirmed, the item will be replaced in accordance with consumer law. If a replacement is not possible, a credit may be issued at our discretion.


6. Use of Products & Resale

Trade purchases may be used for client projects, commercial installations, or retail resale where agreed.

Products should be sold at or near the recommended retail price (RRP). Occasional promotional discounting as part of normal retail activity is acceptable.


7. Images & Project Use

Kirsten Clark Art may request permission to use photographs of completed projects featuring our products for marketing purposes including website, porfolio and social media. 

Credit will be given where appropriate.


8. Changes to Terms

These Trade Terms & Conditions may be updated at any time.
Continued use of a Trade Account constitutes acceptance of the current terms.


9. Privacy

Information provided as part of a Trade Account application will be used solely for the administration of the trade relationship and handled in accordance with applicable privacy laws.


10. Governing Law

These Trade Terms & Conditions are governed by the laws of New Zealand.
